Muzimake ("Muzimake," "we," "us," or "our") provides the Muzimake service subject to these Terms of Use (the "Terms"). These Terms are a binding agreement between you and Muzimake governing your use of our website at muzimake.com (the "Website") and our related products and services (the "Services").
By accessing or using the Website or Services, you agree to these Terms and to our Privacy Policy, which is incorporated by reference. If you do not agree, please do not use the Website or Services.
We may update these Terms from time to time. Changes take effect when posted. Your continued use after a change means you accept the updated Terms.
Who can use Muzimake
We grant you a limited, revocable, non-transferable permission to use the Website for personal, non-commercial use, provided that you use it only for its intended purpose and comply with these Terms and applicable law.
You must be old enough to form a binding contract where you live. You agree to provide accurate information and to keep it current. We may suspend or end access if information is inaccurate or these Terms are violated.
Please do not use bots, scrapers, or similar tools to access the Website faster than a person reasonably could, and do not harvest other people's data or use our contact tools for unsolicited marketing.
How a Muzimake song works
You tell us about the person and the occasion, and we write original lyrics and produce a custom song using AI music tools. You preview and can edit the lyrics before you pay.
After payment, your finished song is saved to your Muzimake account, emailed to you, and available through a shareable gift link you can send to the recipient. Songs are usually ready within minutes; any time estimate we show is a target, not a guarantee.
Each order is for one custom song in the length you choose at checkout (roughly one, two, or three minutes). We may produce more than one take for you to pick from. A substantially new direction after the song is generated may require a new order.
Pricing, payments and refunds
Prices and currency. Prices are shown at checkout (currently from $15, with longer songs at higher tiers) and are charged in the currency displayed. Your bank or payment provider may add conversion or other fees.
Payments. Payments are processed by our payment provider, Stripe. You authorize us and Stripe to charge your selected method for your purchase, including any applicable taxes. Your use of a payment method is also governed by your agreement with that provider.
Refunds.
- Because you preview and approve the lyrics before paying, and the song is generated right after payment, orders are generally non-refundable once the song has been generated.
- If we genuinely cannot deliver your song (for example, an unexpected technical failure we cannot resolve), we will issue a full refund or, if you prefer, regenerate it.
- If we need information from you to complete the order and you do not provide it within a reasonable time, we may cancel and refund the order, minus any non-recoverable processing fees.
The song you receive
When you buy a song from Muzimake, you receive a personal, non-exclusive, non-transferable license to download, keep, and privately enjoy and share the song (for example, with friends and family or on your personal social profiles).
Unless we agree otherwise in writing, please do not sell, commercially license, monetize, collect royalties on, register with a rights organization, or use the song in paid advertising or broadcast. The gift link and any sharing features we provide do not transfer ownership and can be disabled.
We may use short, anonymized snippets of songs to demonstrate the product or for marketing, without revealing private or sensitive details. You can ask us to stop using yours through the chat on our website.
What you submit
You are responsible for the stories, names, details, and any photos you submit (your "Submissions"), and you confirm you have the right to share them and that they do not infringe anyone's rights or break the law. You keep ownership of your Submissions and grant us a worldwide, royalty-free license to use them only to create, deliver, support, and improve your song and the Services.
Photos are optional. Any photos you add are checked on your device for explicit content before upload and are encrypted in your browser, so we store only encrypted data, not viewable images. Please do not upload explicit, illegal, or infringing images.
If you give us a testimonial or public review, you allow us to display it (including your first name and city, if provided) for marketing.
Acceptable use
Do not use Muzimake to create or submit content that is unlawful, infringing, hateful, harassing, defamatory, invasive of privacy, sexually exploitative of minors, or otherwise harmful, and do not impersonate others or upload malware. We may refuse, remove, or moderate content and suspend accounts at our discretion.
Intellectual property
The Website and the Services — and everything that makes them up other than your Submissions and your delivered song — are the exclusive property of Muzimake or its licensors and are protected by copyright, trademark, trade-dress, database and other intellectual-property laws. This includes, without limitation, the “Muzimake” name and logo, our branding and visual identity, the website and product design, layout, look & feel, and user interface, all text and copy, photography, illustrations, graphics and icons, audio and song samples, page structure, and the underlying code and software.
We grant you a limited, personal, non-exclusive, non-transferable, revocable licence to access and use the Website and Services for their intended purpose. We reserve all rights not expressly granted. Except as these Terms expressly allow, you may not — and may not permit any third party to — copy, reproduce, clone, screenshot for reuse, scrape, mirror, modify, adapt, translate, reverse-engineer, republish, distribute, sell, frame, or create derivative or “inspired” works from any part of the Website, Services, design, branding, or content, in any medium, without our prior written permission.
The Muzimake name, logo and brand are our trademarks. You may not use them, or any confusingly similar name or mark, or imitate our look and feel in a way likely to cause confusion, without our written consent. Unauthorised use of our intellectual property is a breach of these Terms and may infringe applicable laws; we actively protect our rights and may pursue all available remedies.
Copyright complaints
We respect intellectual property and respond to clear notices of alleged infringement. A notice should include your signature, identification of the work and the allegedly infringing material (with a URL where possible), your contact details, a good-faith statement that the use is not authorized, and a statement that your notice is accurate.
Send notices to us through the chat on our website with the subject "Copyright Notice, Muzimake." Knowingly false claims may carry legal consequences.
Changes and termination
We may modify, suspend, or discontinue any part of the Website or Services at any time. We may also suspend or end your access for breaking these Terms, unlawful activity, nonpayment, or security issues. On termination, your right to use the Services ends, and we may delete your account and data subject to our Privacy Policy and applicable law.
Disclaimers
Your use of the Website and Services is at your own risk. The Website, Services, and songs are provided "as is" and "as available." To the extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement, and we do not guarantee uninterrupted or error-free operation.
Limitation of liability
To the maximum extent permitted by law, Muzimake and its owners, employees, contractors, and partners will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill, arising from your use of (or inability to use) the Website, Services, or songs. Our total liability for any claim will not exceed the amount you paid for the relevant product in the three (3) months before the claim.
Indemnity
You agree to indemnify and hold harmless Muzimake from claims, losses, and expenses (including reasonable legal fees) arising from your use of the Services, your Submissions, your breach of these Terms, or your violation of any law or third-party right.
Age requirements
The Services are not intended for children under 13. If you are under 13, please do not use them. If you are 13 to 17, use them only with a parent or guardian's consent and supervision.
Communications
When you give us your email (or a phone number, if you choose to), you agree to receive messages needed to run your order, such as confirmations and your delivery link. If you opt in to marketing, you can unsubscribe at any time using the link in our emails or by contacting us. Message and data rates may apply to any text messages.
Governing law
These Terms are governed by the laws of the United Arab Emirates. You agree to the exclusive jurisdiction of the courts of the United Arab Emirates for any dispute relating to these Terms or the Services.
General
If any provision is unenforceable, the rest stay in effect. Our not enforcing a provision is not a waiver of it. We may transfer these Terms as part of a merger, acquisition, or sale of assets; you may not transfer them without our consent. Please bring any claim within one (1) year of when it arises.
